Facts about Earplug Litigation

Between 2003 and 2015 military personnel suffered from permanent hearing loss and other hearing impairments. This was as a result of the defective 3M combat arms earplugs. The 3M combat earplugs that were listed in the lawsuit had a yellow color on one side and a green color on the other side. Each color was there to show a certain level of noise protection for the military personnel that was wearing them. The problem with these earplugs is that they were too short. They also had a problem in that they could loosen the unnoticeably in the military personnel who were wearing the earplugs. These two shortcomings in the earplugs exposed the military personnel to damaging noise levels. These noise levels are what contributed to the hearing loss.


In 2008 the 3M Company was found guilty of knowingly selling defective combat arms earplugs to the military. The lawsuit verdict also stated that they sold these earplugs without disclosing that they could cause hearing loss to the people wearing them. This meant that the US military would have to be given a settlement from the 3M Company. The funds went to the military because the original case had been filed under the False Claims Act. In this case, the money would go directly to the government so that it could compensate for the money that was spent on buying the defective earplugs.
